These Terms & Conditions (“Terms”) govern your use of our website and services, establishing clear guidelines for donors, Champions, and everyone who visits our site.
By accessing GiveClearWater.org, you’re joining a global community supporting the Cofán, Siona, Secoya, Kichwa, and Waorani peoples in their fight for clean water and cultural survival. Please read these Terms carefully, as they establish the foundation for our relationship and outline the rights and responsibilities of everyone using our platform.
Acceptance of Terms
By using GiveClearWater.org, whether you’re browsing our project map, making a donation, or setting up a Champion fundraising page, you agree to be bound by these Terms & Conditions. If you don’t agree with any part of these terms, please don’t use our services.
About Our Services
GiveClearWater.org connects donors and supporters with the ClearWater Project’s work bringing rainwater catchment systems to Indigenous communities in the Ecuadorian Amazon. Our services include:
Project Information: Stories, updates, and an interactive map documenting ClearWater’s work installing rainwater catchment systems across Cofán, Siona, Secoya, Kichwa, and Waorani communities
Donations: Secure online giving to directly fund clean water systems, community technician training, and related project costs
Champion Fundraising: Tools allowing supporters to create and manage their own personal fundraising campaigns on behalf of ClearWater
Educational Content: Resources about the oil contamination crisis in Ecuador’s northern Amazon, the communities we work with, and the impact of our clean water solutions
User Responsibilities
Eligibility
GiveClearWater.org is intended for donors, supporters, and Champions age 18 and older. By using our site, including making a donation or creating a Champion campaign, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
Account Registration
When creating a Champion fundraising account or submitting content to our site, you agree to:
Provide accurate, current, and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized use of your account
Accept responsibility for all activities under your account
Acceptable Use
You agree to use GiveClearWater.org responsibly. Specifically, you agree not to:
Use our services for any unlawful purpose
Attempt to gain unauthorized access to our systems
Interfere with other users’ or Champions’ use of our services
Submit content that is offensive, defamatory, or violates others’ rights
Use automated systems to scrape or harvest our content
Impersonate another person or entity
Misrepresent your Champion fundraising campaign or misuse funds raised on ClearWater’s behalf
Champion Fundraising Campaigns
Champion Responsibilities
Individuals who create a Champion fundraising campaign agree to:
Represent ClearWater’s mission accurately in their campaign materials
Use their campaign solely to raise funds for ClearWater’s work
Not imply an official endorsement, employment, or partnership with ClearWater beyond that of a volunteer fundraiser
Comply with all applicable laws and platform guidelines governing charitable fundraising
Fund Disbursement
100% of funds raised through a Champion campaign go directly to ClearWater’s project work. We make reasonable efforts to ensure funds are processed accurately and promptly, but processing times may vary depending on our payment platform and partners.
Intellectual Property Rights
Our Content
All content on GiveClearWater.org, including our project stories, interactive map, photographs, site design, and logos, is protected by copyright and other intellectual property laws.
User-Generated Content
When you submit comments, photos, or other content to our site or as part of a Champion campaign, you grant GiveClearWater.org a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with our services.
You retain ownership of your content but represent that you have the right to submit it and that it doesn’t violate any third-party rights or applicable laws.
Disclaimers and Limitations
Service Availability
While we strive to keep GiveClearWater.org available at all times, we don’t guarantee uninterrupted access. We may need to perform maintenance or updates that temporarily affect service availability, including our donation and Champion fundraising tools.
Project Information
We work diligently to keep information about our projects, partner communities, and impact accurate and current. However, conditions in the field can change, and figures such as systems installed or people served are updated periodically rather than in real time.
Limitation of Liability
To the fullest extent permitted by law, GiveClearWater.org, the ClearWater Project, and their officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
Our total liability for any claims related to our services shall not exceed the amount you donated to us in the twelve months preceding the claim, or $100, whichever is less.
Indemnification
You agree to indemnify and hold harmless GiveClearWater.org and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
Your use of our services
Your violation of these Terms
Your violation of any third-party rights
Content you submit to our platform
Your conduct as a Champion fundraiser

Third-Party Links and Services
GiveClearWater.org contains links to our partner organizations—including Amazon Watch, Digital Democracy, and Rainforest Action Network—as well as our donation and Champion fundraising platforms. We’re not responsible for the content, policies, or practices of these external sites. When you leave our site to visit a partner or third-party resource, you’re subject to their terms and policies.
Modifications to Terms
These Terms may be updated to reflect changes in our services, legal requirements, or organizational practices. We’ll notify you of material changes by:
Posting updated Terms on our website with a new “Effective Date”
Sending email notification to registered Champions when appropriate
Providing reasonable notice before changes take effect
Your continued use of GiveClearWater.org after changes constitutes acceptance of the updated Terms.
Termination
Either party may terminate this agreement at any time. We may suspend or terminate your access to GiveClearWater.org, including a Champion fundraising campaign, if you violate these Terms or engage in conduct we reasonably believe is harmful to our community or mission.
Upon termination, your right to use our services ceases immediately, though provisions regarding intellectual property, disclaimers, limitations of liability, and indemnification survive termination.
Dispute Resolution
Governing Law
These Terms are governed by the laws of North Carolina, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of Durham County, North Carolina.
Informal Resolution
Before pursuing formal legal action, we encourage you to contact us at contact@hives.net to discuss any concerns. Many issues can be resolved through direct communication.
Arbitration
Any disputes that cannot be resolved informally may be subject to binding arbitration in Durham County, North Carolina, in accordance with the rules of the American Arbitration Association.
General Provisions
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and GiveClearWater.org regarding your use of our services.
No Waiver
Our failure to enforce any provision of these Terms doesn’t constitute a waiver of that provision or any other provision.
Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
